Man Released From Prison After Justice Throws Out Conviction

AUGUSTA, Maine - An Augusta man who was imprisoned for more than three years on sexual assault charges has been released after his convictions were overturned.

The Kennebec Journal reports 39-year-old Jonathan Carey was released Monday after a Superior Court justice threw out convictions of unlawful sexual contact and sexual touching.

She said Carey's attorneys inadequately represented him during his trial.

Carey was accused of sexually assaulting a sleeping 13-year-old and was sentenced to four years in prison. The District Attorney said Wednesday she is deciding whether to appeal and go forward with a new trial.

Carey has maintained he is innocent of the charges and refused to accept a plea bargain that would have sentenced him to 30 days in prison.

He's due back in court in October.
