Maine's High Court to Hear Appeal in Publicist's Death Suit

PORTLAND, Maine - Maine's highest court will hear an appeal of a failed wrongful death lawsuit filed by the husband of a publicist for Hollywood stars after she died from a fall.

The Portland Press Herald reports that a lower court rejected Eugene Smith's claims that the owner of The Maine Farm House was responsible for the death of Lois Smith. Lois Smith's clients included Marilyn Monroe, Martin Scorsese and Rosie O'Donnell. She fell while staying at The Maine Farm House in Bryant Pond in 2012.

Eugene Smith has argued that his wife's fall was caused by negligent design of a staircase. Smith was 84 at the time of her death.

The appeal will be heard Wednesday. An attorney for the farm house's owner says no one knows what caused Smith to fall.
