FARMINGTON, Maine - A lawsuit against the town of Farmington, the police chief and an officer filed by the parents of an Army veteran shot and killed by police will move forward after the town rejected a settlement.
The Morning Sentinel reportsthat details of the proposal are confidential, but attorneys said the case is continuing.
The parents of 28-year-old Justin Crowley-Smilek allege in their wrongful death lawsuit that Officer Ryan Rosie used unreasonable force when he shot their son, who had a knife, in 2011.
Crowley-Smilek was suffering from post-traumatic stress from duty in Afghanistan.
The suit alleges the officer never called for backup and continued firing after Crowley-Smilek was disarmed. It seeks unspecified damages.
An investigation by the state attorney general's office determined that the officer was justified in using deadly force.
