Group Asks High Court to Reconsider Harpswell Beach Access Ruling

HARSPWELL, Maine - The attorney for a group of people that want to preserve public beach access in Harpswell is asking Maine's highest court to reconsider a decision to give the property's owner the right to block access.

The Portland Press Herald reports that attorney David Bertoni filed a motion for reconsideration at Maine Supreme Judicial Court on Tuesday.

Supreme court justices unanimously vacated a lower court's judgment that the public had established the right to use a private access road to get to Cedar Beach.

Cedar Beach was used by the public for decades until 2011. That was when the road was barricaded by the couple who owned it at the time. An attorney for the access road's owner says she will allow the public to use it unless they abuse it.
