Windham Man Killed by Police Had Gun at His Side

PORTLAND, Maine — The state attorney general's report on the shooting of a Windham man by a Cumberland County sheriff's deputy says the victim had had his hands — including one holding a gun — by his side when he was killed.

The report supports claims by Stephen McKenney's widow that he wasn't waving the gun around when he was shot, as police originally had said.

The report obtained by the Portland Press Herald under a freedom of access request also states police made no verbal commands to McKenney for six minutes and 10 seconds after he was told to drop his gun. He was shot nine seconds later.

McKenney's wife had called police because her armed husband was suicidal.

The attorney general's office found that the use of deadly force was justified.
