Maine Bill Takes Aim at Warrantless Searches

AUGUSTA, Maine - An Auburn lawmaker is proposing legislation that would prohibit state and local law enforcement agencies from using electronic data collected by federal agencies without court approval.

Republican Sen. Eric Brakey says the Constitution needs some help.

"It hasn't stopped the federal government from doing that, even though it is in the Constitution," Brakey said. "I think it is a very good idea to reinforce what is already in the Constitution with statutory language in the law."

He says it's clear the federal government is not enforcing the Fourth amendment to the U.S. Constitution, requiring a search warrant for personal information.

The legislation now goes to the Legislature's Criminal Justice and Public Safety Committee for a public hearing.
