Judge Rejects Effort to Get Pot on York Ballot

YORK, Maine - A judge has rejected a request by pro-marijuana activists that would have forced the town of York to put a legalization question on the November ballot.

The Portland Press Herald reports that Superior Court Judge Paul Fritzsche said in his ruling on Friday that York can't regulate marijuana use because it's not governed by local ordinances. It's governed by state and federal law.

After activists gathered enough signatures, York's selectmen voted not to put the measure on the ballot by a count of 3-2 at a meeting earlier this month. Some York officials argued that legalizing marijuana would conflict with the town's charter.

Marijuana legalization measures will appear on the November ballot in South Portland. Organizers are also hoping to put the measure on the ballot in Lewiston.
